Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Rock Paper Vision (the “Service”), a free browser game that reads rock, paper, or scissors hand gestures from your webcam. In these Terms, “we”, “us”, and the “operator” mean the operator of the Service. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Changes to these Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to bring it to your attention. Changes take effect when posted, and continued use of the Service after that means you accept the updated Terms. If you do not accept a change, stop using the Service.

Eligibility and children

The Service is intended for a general audience and is not directed to children under 13. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who accepts these Terms on your behalf and supervises your use. Online multiplayer shows your live camera to another person, who may be a stranger; a parent or guardian is responsible for deciding whether a child may use online play and for supervising it. Licence to use the Service

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment. You must not copy, modify, reverse engineer, resell, or build a competing product from the Service, and you must not use it unlawfully. All intellectual property in the Service belongs to the operator or its licensors.

Acceptable use

You are responsible for your conduct while using the Service, including in online multiplayer. Do not use the Service to harass others, to transmit unlawful or infringing material, to interfere with or overload the Service or its providers, or to attempt to gain unauthorised access. We do not monitor online play and are not responsible for the conduct of other players.

Your camera and online video

The Service uses your device camera to read your hand gestures. You are responsible for your camera, your surroundings, and anything that is visible while you use the Service. Use it only where you are comfortable doing so and only with equipment you are permitted to use.

In online multiplayer your live camera is streamed directly to the other player so each of you can see the other's hands. The other player can see your video and may be able to record or screenshot it on their own device, which is outside our control. A room is reached using a short code, so you decide who can join: share a code only with people you trust, and treat any online opponent as a member of the public. You must not use your camera or online play to transmit unlawful, harassing, threatening, sexually explicit, or infringing content, or to record, capture, or share another person without their consent.

We do not watch, moderate, record, or store online video, and we are not responsible for what another player does, sends, sees, or records. You use online video at your own risk.

The Service is provided “as is”

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all warranties and representations, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uptime, and availability. Gesture recognition depends on your camera, lighting, and device and may be inaccurate, so you should not rely on the Service for anything important.

Your statutory rights (Australian Consumer Law)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee can be limited (but not excluded), our liability is limited, at our option, to re-supplying the Service or paying the cost of having it re-supplied. If you are a consumer elsewhere, you may have similar non-excludable rights that these Terms do not override.

Limitation of liability

Subject to the section above, and to the maximum extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the Service;
  • we are not liable for matters outside our reasonable control, for third-party services, or for the conduct or decisions of you or other users; and
  • our total aggregate liability arising out of or relating to the Service is limited to AUD $100 or, if greater, the amount you paid us to use the Service in the 12 months before the claim (which, for a free service, is nil).

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or under non-excludable consumer guarantees.

Indemnity

To the extent permitted by law, you agree to indemnify the operator against reasonable losses and costs arising from your unlawful use of the Service, material you transmit through it, or your breach of these Terms. We do not indemnify you.

Feedback

If you send us ideas, suggestions, or feedback about the Service, we may use them for any purpose without restriction and without any obligation, payment, or credit to you.

Third-party services

The Service relies on third-party infrastructure (for example hosting, analytics, and realtime messaging). We are not responsible for those services, and your use of the Service may also be subject to their terms.

Suspension and discontinuation

We have no obligation to maintain, update, or support the Service, and we may change, suspend, or discontinue it, in whole or in part, at any time without notice and, to the maximum extent permitted by law, without liability to you.

Governing law and disputes

These Terms are governed by the laws of Victoria, Australia, and the courts of that place have non-exclusive jurisdiction over any dispute. Nothing in this section deprives you of the protection of mandatory consumer laws, or of the courts, of the place where you live. To the extent permitted by law, disputes are to be resolved individually rather than as part of a class or representative proceeding.

General

If any provision of these Terms is held unenforceable, it is severed and the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. We may assign these Terms in connection with a transfer of the Service; you may not assign them. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and the operator about the Service.
